July 12, 2010 Public Hearing Zoning Changes
TOWN OF UTICA TOWN MEETING MINUTES JULY 12, 2010 1. CALL TO ORDER. Chairman Nelson Hinz called the July 12, 2010 meeting to order at 6:30 p.m. at the Utica Town Hall. Nelson Hinz, Chairman, Kathy Paschke, Supervisor #1, Fredrick Marohn, Supervisor #2, Betty Messerschmidt, Treasurer, and Brenda Morrell, Clerk were present. 18 Citizens were in the audience. 2. RECEIVE INPUT FROM RESIDENTS ABOUT ZONING ORDINANCE REVISIONS AS PUBLISHED. Chairman Hinz summarized the changes to the Zoning Ordinances. Public Comments included the following: • Lyle Forsgren asked what the rational was in changing setbacks from 100 to 75 feet. He felt the consensus was that townspeople wanted a more rural look and therefore the longer setbacks. It was safer to put them further from the road. Chairman Hinz replied the change was considered because of the number of variances that were asked for in the past few years. He thought 75 was the state mandate. • Sandy Forsgren clarified that the rational for setbacks may be a mute point, based on the non-conforming changes as presented in the Zoning ordinance revisions document. • Chairman Hinz discussed that in letter J. Article VI, the sentence reading: “Thereafter, the driveway may narrow to a minimum of ten (10) feet.” Should be eliminated. • Chairman Hinz discussed that under letter L. Article VI, Section 3(A)(3)(c) shall be amended to read as follows: “Town Engineer” should be changed to “Zoning Administrator”. • Unanimous should be changed to read majority vote per Board. Nelson asked for a motion to approve the amendments as presented for the Town Board to approve at the Town meeting tonight. Tom Thiel made the motion, seconded by Walt Whiting. 11 ayes and 3 nays. Carried. 3. RECEIVE INPUT FROM RESIDENTS ABOUT WEED RESTRICTIONS. Marty Witczak asked the Board to take some action on the weed issue as it pertains to his neighbor. Supervisor Paschke explained that the nuisance ordinance was voted down less than a year ago, and that the Town does not have jurisdiction on any one singled out property. State weed ordinance does not apply to most of the weeds at issue in this case. It was suggested that the covenants be revisited with the subdivision, or that Marty could present an ordinance that the board could present to the public. May also work at getting all non-developed lots in the subdivision mowed. Imperial Hills Association could look over its covenants. Richard Thill is in support of Marty Witczak in this case. He discussed the noxious weeds ordinance and the pile of dirt sitting in the ditch blocking water flow. Concerns were expressed about the number of outside play toys, the number of families living in this house, the number of cars always outside and on the road and the lack of upkeep. Board suggested working with the covenants of the subdivision. 4. ADJOURNMENT Sandy Forsgren, made a motion, seconded by Chuck Kuhrt , to adjourn. Ayes. Carried.
