TOWN OF UTICA TOWN BOARD MEETING MINUTES July 12, 2010 1. CALL THE MEETING TO ORDER. The July 12, 2010 meeting was called to order by Chairman Nelson Hinz at 7:38 p.m. at the Utica Town Hall. Nelson Hinz, Chairman; Kathy Paschke, Supervisor #1; Frederick Marohn, Supervisor #2; Betty Messerschmidt, Treasurer and Brenda Morrell, Clerk were present. 24 citizens were in the audience. 2. APPROVE JUNE 14, 2010 TOWN MEETING MINUTES. The minutes of the June 14, 2010 Town board meeting were reviewed. Supervision Paschke made a motion, seconded by Supervisor Marohn to accept the minutes as presented. 3 ayes and 0 nays. Carried. 3. APPROVE TREASURER’S REPORT. Treasurer Messerschmidt read the Treasurer’s report. Receipts were $8,555.74. Disbursements were $22,507.05. The checkbook balance is $156,777.63. Supervisor Marohn made a motion, seconded by Supervision Paschke to accept the Treasurer’s Report as read. 3 ayes and 0 nays. Carried. 4. ADOPT AGENDA. 5. PUBLIC FORUM. Ron Meier asked if we get benefits/tradeoffs when we work with the county, therefore making the lowest bid not necessarily the best deal. He expressed concern about the blacktop on the cul de sac on Stevens Lane. Also asked that people should not speak freely in Town meetings to keep order. Roman Bauer asked why Fireworks permits are needed (state statue as expressed by Chairman Hinz). Roman expressed concern for his horses because the fireworks were set off too close to his house. Discussion about when the permits need to be issued. Also wants to discuss peacock issue and complaints for August. Sandy Forsgren asked if a fireworks permit has to be given to an individual - can they be denied a permit? Keep track of those who are irresponsible and not issue to those the next year. Chuck Kuhrt wanted to make us aware that the stop sign on Hwy 91 and Bradley Road is down. Betty Messerschmidt got a call about dogs on the corner of County M and Mahlke Road ( without licenses) that are running out when bicyclist go by. David Bradley wanted to know about a zoning change in February with regard to his property that was tabled. He thought there should be a written policy to notify the adjacent property owners of the status. Shirley Gallert wanted to say thank you to Michael Christianson for cutting the weeds down by the curve on Hwy 44 and Fisk Avenue. Officer was present to answer questions there were none. 6. SURVEY COMPANY SPEAKER. No one showed. 7. SANITARY DISTRICT UPDATE. Clerk Morrell reported that the paperwork for the vacation of the Imperial Hills sanitary district has been filed with the register of deeds and that the matter is closed. 8. CONCRETE WALKWAY TO PAVILLION. Ed Hunter informed the board that the concrete will be donated by the Potratz brothers and therefore the Town will not have to pay for that. The fire department will provide the labor for the project. 9. DOMINION VOTING SYSTEMS AS PROVIDER FOR PREMIER VOTING EQUIPMENT SYSTEMS PRODUCTS. Clerk Morrell reported that Dominion Voting Systems is the provider that was chosen by the County to handle the service and parts contract for the voting equipment. This allows them to upgrade equipment if necessary, where as the other provided could not. It was determined that the Town would follow the county with regard to this issue. 10. TEMPORARY LIQUOR GARDEN TRACTOR PULL. The applications for liquor, tobacco and cigarette licenses were reviewed. Chairman Hinz made a motion, seconded by Supervisor Paschke to approve the licenses as presented upon the receipt of payment for the licenses. 3 ayes and 0 nays. Carried. 11. AMENDMENTS TO THE PLANNING AND ZONING CODE. Supervisor Paschke made a motion, seconded by Supervisor Marohn to approve the zoning changes as presented with the following changes: 3 ayes and 0 nays. Carried. • Keep setback definition as printed in the draft version of the ordinance # 75 on page 11 which reads: “The required distance between the existing property boundary line and the location of any structure existing or to be constructed on a parcel. Front yard setback is the distance from the right-of-way which is a minimum of thirty-three (33) feet from the center of the road to the location of any structure.” • Change throughout the ordinance to be amended to replace “Town Engineer” with “Town Zoning Administrator”. • Letter J, Article VI, the sentence reading: “Thereafter, the driveway may narrow to a minimum of ten (10) feet.” should be stricken. • Letter K, Article VI revised to read: All end walls shall have at least a 2 to 1 slope (horizontal measure to vertical measure) from the top of the driveway to the end of the apron. 12. DISCUSS WEED ISSUES. No further discussion except to try and enforce the noxious weeds. Parties should seek help from local covenant committee. 13. AMENDMENTS TO 2010 BUDGET CATEGORY ITEMS. Will address next month. 14. ITEMS FOR INCLUSION IN NEWSLETTER. Fireman’s Picnic August 29th. – looking for pies and any volunteers from anyone in the community – contact Tom Bean and /or Patsy Beck if you can help or want tickets. If a building permit is needed (values for over $1,000 appraised value including labor and material) and not obtained - a citation will be issued and it will double the price of the permit. All dogs require licenses annually - talk to Betty Messerschmidt if you need one. Zoning changes have to be in compliance with the comprehensive plan. Plan ahead and come to a meeting for an informal opinion if you anticipate needing a change as requests are not guaranteed and can take several months for changes. Need for a new supervisor – contact Chairman Hinz if you are interested in being considered. Also in need for an alternate for the Rush Lake Watershed Committee 15. REPORTS: • Board of Appeals. • Nelson got an application from Gary Biesinger and he has not contacted him with completed forms. • Fire Department. • Picnic • New business in dryer plan • Plan Commission. • Supervision Paschke made a motion, seconded by Supervisor Marohn to approve the New Certified Survey Map for Ashley and Jessica Rhines and Phillip and Judith Drexler. 3 ayes and 0 nays. Carried. • Clerk is to keep track of the non-conforming use of this property in a separate ledger. • There are two applications for which a meeting will be held on August 5th. • Educational Opportunities. • Royal Ridges – A budgeting and finance workshop will be held on September 1, 2010 16. CORRESPONDENCE. • Nelson received a letter from Kathy Paschke regarding her resignation; therefore, the town will have to appoint a new supervisor. • Bob Hunter has given his resignation for the Rush Lake Watershed Committee. Anyone interested in this position should contact Chairman Hinz. • There have been complaints about smell near Mountain Road 17. POINTS OF INTEREST. None 18. APPROVE PAYMENT OF BILLS. Supervisor Marohn made a motion, seconded by Supervision Paschke, to pay the bills as submitted by the Clerk. 3 ayes and 0 nays. Carried. 19. ADJOURNMENT. Supervision Paschke made a motion, seconded by Supervisor Marohn to adjourn. 3 ayes and 0 nays. Carried.
