TOWN OF UTICA
TOWN BOARD MEETING MINUTES
July 13, 2009
1. CALL TO ORDER.
Chairman Nelson Hinz called the July 13, 2009 meeting to order at 7:30
p.m. at the Utica Town Hall. Nelson Hinz, Chairman, Kathy Paschke,
Supervisor #1, Frederick Marohn, Supervisor #2, Betty Messerschmidt,
Treasurer and Jack Clarke, Clerk were present. 30 citizens were in
the audience.
2. APPROVAL OF MINUTES.
The minutes of the June 8, 2009 meeting were reviewed. Supervisor
Marohn made a motion, seconded by Supervisor Paschke, to accept the
minutes. Carried.
3. TREASURER’S REPORT.
Treasurer Messerschmidt read the Treasurer’s report. Receipts were
$13,989.43. Disbursements were $31,522.64. Check book balance is
$90,014.70. Supervisor Paschke made a motion, seconded by Supervisor
Marohn, to accept the Treasurer’s Report. Carried.
4. ADOPT AGENDA.
Chairman Hinz read the Agenda for the meeting.
5. PUBLIC FORUM.
- A resident reminded the Board that a no vote was taken at the Town
Public Hearing regarding the ordinance prohibiting public nuisances in
the Town Of Utica.
- A resident feels that the town attorney should be fired.
- A resident believes that the Town Zoning Ordinance has 50 items that
are incorrect. They shared several sections that they feel are
incorrect.
- A resident disagrees that the attorney should be fired and feels
that the Zoning Ordinance was well studied and well written.
6. CONSIDER THE ADOPTION OF THE FOLLOWING ORDINANCES:
· ORDINANCE REVISING SECTION 12(B)(3) OF THE TOWN OF UTICA ZONING
ORDINANCE.
Supervisor Paschke made a motion, seconded by Supervisor Marohn, to
adopt this ordinance as presented. Carried.
· ORDINANCE CLARIFING DEFINITIONS USED IN THE TOWN OF UTICA ZONING
ORDINANCE.
Supervisor Marohn made a motion, seconded by Supervisor Paschke, to
adopt this ordinance as presented. Carried.
· ORDINANCE PROHIBITING PUBLIC NUISANCES IN THE TOWN OF UTICA.
Supervisor Paschke made a motion, seconded by Supervisor Marohn, to
not adopt this ordinance.
Carried.
7. DETERMINE ROAD MAINTENANCE PROJECTS FOR 2009.
Supervisor Marohn made a motion, seconded by Supervisor Paschke, to
pulverize and grind up Knott Road, add gravel as needed and double
seal coat the road from the railroad tracks to the golf course at a
cost of $62,000.00, and to fill cracks and seal coat other major town
roads. Carried.
8. CLERK POSITION
A special Town Board meeting was scheduled for July 27, 2009 beginning
at 6:15 p.m. to interview candidates.
9. REPORTS:
1. Board of Appeals.
a. Chairman Hinz shared that a Board of Appeals meeting was held at
the John and Sharon Achterberg property. Variance approved.
b. Chairman Hinz shared that a Board of Appeals meeting was held at
the Larry and Ronda Spratto property. Variance approved.
2. Fire Department.
Chief Hunter reported that the recall on Engine 12 has been taken care
of. He also shared that the annual Fireman’s Picnic will be held on
August 30, 2009. Everyone was invited to make pies for the event.
3. Plan Commission.

4. Educational Opportunities.
Supervisor Paschke made a motion, seconded by Supervisor Marohn, to
send the new clerk to the Wisconsin Municipal Clerks Association, New
Clerks class in Milwaukee, August 19, 2009. Carried
10. CORRESPONDENCE.
None shared.
11. PAYMENT OF BILLS.
Supervisor Marohn made a motion, seconded by Supervisor Paschke, to
pay the bills. Carried.
12. ADJOURNMENT.
Supervisor Marohn made a motion, seconded by Supervisor Paschke, to
adjourn. Carried.
