July 14, 2008 Town Board Meeting
TOWN OF UTICA TOWN BOARD MEETING MINUTES 1. CALL TO ORDER. The July 14, 2008 meeting was called to order by Chairman Nelson Hinz at 7:30 p.m. at the Utica Town Hall. Nelson Hinz, Chairman; Kathy Paschke, Supervisor #1; Frederick Marohn, Supervisor #2, Betty Messerschmidt, Treasurer and Jack Clarke, Clerk were present. 19 Citizens were in the audience. 2. APPROVAL OF MINUTES. The minutes of the June 9, 2008 meeting were reviewed and corrected. Supervisor Marohn made a motion, seconded by Supervisor Paschke, to accept the corrected minutes of the June 9, 2008 minutes. Carried. The minutes of the June 24, 2008 meeting were reviewed. Supervisor Marohn made a motion, seconded by Supervisor Paschke, to accept the minutes. Carried. 3. TREASURER’S REPORT. Treasurer Messerschmidt read the Treasurer’s report. Receipts were $27.41. Disbursements were $19,476.90. The check book balance is $60,297.84. Supervisor Paschke, made a motion, seconded by Supervisor Marohn to accept the Treasurer’s Report. Carried. 4. ADOPT AGENDA. Chairman Hinz read the Agenda for the meeting. 5. PUBLIC FORUM. Winnebago County Sheriff’s deputy T. Eichman shared that the Winnebago County Sheriff’s Department is available to assist town residents when called upon. Chairman Hinz asked the Sheriff’s department to look into a problem of children playing in the road on Hillside Road. A resident asked him to look into a problem of cars parked too close to the road blocking a driver’s view at the corner of Highway 44 and County Road M. A resident asked about putting up a memorial plaque for Lawrence Bradley in honor of his many years of service to the town. This will be an agenda item for the August meeting. A resident asked about doing something to the trees on Bonnieview Road. Every time we have a storm, some limbs fall on the road, requiring that they be removed. A resident mentioned that there may be some trees on County Road FF, about ¼ mile south of Highway 91, which may have weakened roots due to sitting in water. Also a tree, which is in the road right away on Kings Lane, may cause a problem when it gets larger. 6. DUTES OF THE CONSTABLE. The clerk was asked to obtain information about what neighboring towns have in place regarding a constable. 7. RUSH LAKE COMMITTEE APPOINTMENT. Chairman Hinz made a motion to appoint Tom Davis Jr. to the Rush Lake Committee to replace Lawrence Bradley, seconded by Supervisor Marohn. Carried. 8. NEW BASEBALL DIAMOND. There was no one present to report on the project. 9. NEW FIRE TRUCK LOAN REQUIREMENTS. Chairman Hinz, Treasure Messerschmitt and Clerk Clarke will meet at Community First Credit Union at 3:00 p.m. Friday July 18 to sign the loan papers. 10. FLOODING ISSUES. • RAILROAD CULVERT. There needs to be a new culvert installed under the railroad tracks north of the old locker plant in Pickett. The railroad stated that they would install the culvert if the town would purchase it. The culvert would cost about $10,000.00. No action taken. • POKLASNY DRAINAGE. Jim Poklasny would like to dig the ditch on Bonnieview, east of his home to County Road FF deeper, so that the water that accumulates on his land can drain away. There was no one present to report on the project. No action taken. 11. ROAD INSPCTION REPORT. Chairman Hinz, Supervisor Paschke and Supervisor Marohn toured the town roads on June 30, 2008 and reported that they found shoulders that needed repairing in various areas in the town. 12. WATER TESTING DATES. July 19, 2008 - Radon and water test kits will be available to be picked up on Saturday July 19 from 11:00 a.m. to 2:00 p.m. at the Town Hall. Radon test costs, payable to the Town of Utica on June 19 will $ 4.00. Water test costs, payable to Clean Water Testing on June 22 will be as follows: $15.00 for Arsenic testing $15.00 for Nitrate testing $15.00 for Bacteria testing July 22, 2008 - You will need to return your water test kits to the Town Hall on Tuesday July 22 from 4:00 p.m. to 7:00 p.m. along with your check or cash. August 26, 2008 - Representatives from the Winnebago County Health Department and Clean Water Testing will be available on August 26 at 7:00 p.m. to explain test results. 13. REPORTS. 1. Board of Appeals. None 2. Fire Department. a. Status of new fire trucks. The new pumper will be delivered to the Town Hall at about 6:00 p.m. on July 22, 2008. 3. Plan Commission. a. Act on Zoning Recommendations. 1. Chairman Hinz made a motion to rezone the 39.417 acres from A-1 to Rural Recreational and Residential Mixed Use Lot 1 on the Gerald and Thomas Konrad property. Seconded by Supervisor Paschke. Carried. 2. Chairman Hinz made a motion that the 39.417 acres on the Gerald and Thomas Konrad property be divided into three parcels as shown on the submitted CSM. Seconded by Supervisor Paschke. Voice vote: Chairman Hinz and Supervisor Paschke for, Supervisor Marohn against. Carried. 3. Supervisor Marohn, made a motion, to approve the CSM as submitted by Tod Davies and recommended by the Plan Commission, creating a 5.5038 acre parcel (Lot) with the stipulation that a deed restriction be put on Lot 2 that it cannot be sold as a separate lot from the contiguous agricultural parcel owned by David Davies. Seconded by Chairman Hinz. Carried. 4. Supervisor Paschke made a motion to rezone Lot 1 on submitted CSM from A-1 to Rural Recreational and Residential Mixed Use as submitted by Tod Davies and recommended by the Plan Commission,. Seconded by Supervisor Marohn. Carried. 4. Educational Opportunities. Supervisor Marohn made a motion to send Chairman Hinz, Supervisor Marohn, Treasurer Messerschmidt and Clerk Clarke, to the WTA Budget and Finance Workshops, 9/18/08 in Ripon. Seconded by Supervisor Paschke. Carried. 14. CORRESPONDENCE Clerk Clarke shared a letter received from the IRS changing the mileage amount from $0.505 to $0.585 per mile from July 1, 2008 to December 31, 2008. 15. PAYMENT OF BILLS Supervisor Marohn made a motion, seconded by Supervisor Paschke to pay the bills. Carried. 16.
