TOWN OF UTICA BUDGET MEETING MINUTES November 10, 2008 1. CALL TO ORDER The November 10, 2008 meeting was called to order by Chairman Nelson Hinz at 6:30 PM at the Utica Town Hall. Nelson Hinz, Chairman; Kathy Paschke, Supervisor #1; Frederick Marohn, Supervisor #2, Betty Messerschmidt, Treasurer, Jack Clarke, Clerk and 29 residents were present. 2. 2009 BUDGET. • APPROVE 2009 HIGHWAY FUNDING Residents voiced their concerns that the town was not keeping the road infrastructure up as needed and voiced a desire to increase the town highway funding to accommodate paving and or seal coating a limited number of miles of roads each year. The larger size of farm equipment, grain hauling wagons, and increased truck traffic on town roads are taking a toll on the roadways. Residents asked that a road survey be conducted next spring and a priority set as to what roads need to be worked on each year. Bernard Egan, resident of the Town of Utica, made a motion, seconded by Kevin Fritz, resident of the Town of Utica, to allocate in the Town of Utica 2009 budget, $300,000.00 for highway funding. Hand raised vote by residents, 13 ayes, and 8 nays. Carried. • APPROVE RESOLUTION TO EXCEED STATE LEVY LIMITS Per Sec. 66.0602 (5) of WI, Statutes, which allows the town electors in towns under 2000 in population to exceed the maximum allowable levy limits by adoption of a resolution at a town meeting of the electors. Whereas, a special town meeting of the electors has been noticed and called this 10th day of November, 2008. Now, therefore, the special town meeting of the Town of Utica, Winnebago County, Wisconsin by a majority vote of the eligible electors voting on this 10th day of November, 2008 duly assembled and voting resolves and orders as follows: Betty Bradley, resident of the Town of Utica, made a motion, seconded by Walter Whiting, resident of the Town of Utica, to authorize the Town to exceed the State levy limit for the Town of Utica of $143114.00. 18 ayes and 7 nays. Carried. • APPROVE TOWN LEVY LIMIT Per Sec. 60.10 (1) (a) of WI, Statutes authorizes the town electors of a town to adopt the town tax levy at a town meeting of the electors. Whereas, a special town meeting of the electors has been noticed and called this 10th day of November, 2008. Now, therefore, the special town meeting of the Town of Utica, Winnebago County, Wisconsin by a majority vote of the eligible electors voting on this 10th day of November, 2008 duly assembled and voting resolves and orders as follows: Bernard Egan, resident of the Town of Utica, made a motion, seconded by Robert Potratz, resident of the Town of Utica to set the 2009 levy at .0028487556. Hand raised vote by residents, 18 ayes, and 5 nays. Carried. 3 ZONING CHANGE TO RURAL RECREATIONAL AND RESIDENTIAL MIXED USE DISTRICT. The Plan Commission of the Town of Utica made a recommendation to the Town Board to make some changes to the Town Zoning Ordnance in regard to the section on Rural Recreational and Residential Mixed Use, to comply with State requirements. The Town board is recommending to the Town residents that it adopt the attached changes. (See attached zoning changes) Sandy Forsgren,] resident of the Town of Utica, made a motion, seconded by Robert Potratz, resident of the Town of Utica, to approve this zoning change. Carried. 4. CONSTABLE POSITION. The following question was presented to the residents: Should the Town of Utica eliminate the position of Town Constable and authorize the Town Board the option of appointing an Animal Control person? After some discussion, David Hielke, resident of the Town of Utica, made a motion, seconded by Robert Hunter, resident of the Town of Utica, to continue to elect a Town Constable. Voice vote. Carried. 5. ADJOURNMENT Frederick Marohn, resident of the Town of Utica, made a motion, second by Robert Potratz, resident of the Town of Utica, to adjourn. Voice vote by residents. Carried.
