TOWN OF UTICA
TOWN BOARD MEETING MINUTES
November 9, 2009
1. CALL TO ORDER.
Chairman Nelson Hinz called the November 9, 2009 meeting to order at
7:30 p.m. at the Utica Town Hall. Nelson Hinz, Chairman, Kathy
Paschke, Supervisor #1, Frederick Marohn, Supervisor #2, Betty
Messerschmidt, Treasurer and Brenda Morrell, Clerk were present. 27
citizens were in the audience.
2. APPROVAL OF OCTOBER 12, 2009 MINUTES.
The minutes of the October 12, 2009 meeting were reviewed. Supervisor
Paschke made a motion, seconded by Supervisor Marohn to accept the
minutes. 3 ayes and 0 nays. Carried.
3. APPROVAL OF OCTOBER 19, 2009 MINUTES.
The minutes of the October 19, 2009 budget meeting were reviewed.
Supervisor Marohn made a motion, seconded by Supervisor Paschke to
accept the minutes. 3 ayes and 0 nays. Carried.
4. TREASURER’S REPORT.
Treasurer Messerschmidt read the Treasurer’s report. Receipts were
$34,176.62. Disbursements were $65,914.98. Check book balance is
$91,074.44. Supervisor Marohn made a motion, seconded by Supervisor
Paschke, to accept the Treasurer’s Report. 3 ayes and 0 nays.
Carried.
5. ADOPT AGENDA.
Chairman Hinz read the Agenda for the meeting.
6. PUBLIC FORUM.
Sally Marohn commented on the minutes presented from the Oct 12
meeting with regard to the question of pulling over for first
responders. She asked if the public please would pull over for them.
Lyle Forsgren asked that the contracts with private contractors should
not be taken away once they are voted on as was the case with for
snowplowing this year.
Walt Whiting commented on the Board of Appeals in that there is a
timeframe on the variances that the town issues and how long they have
to be acted on.
John Groth asked about the rubble pile on the Mountain and Sportsmans
Roads. Wondering when it would be cleaned up.
Bob Mitchell asked the board to act quickly with regard to a variance
for him to build a bedroom onto his house.
7. APPROVE 2010 BUDGET.
Supervisor Marohn made a motion, seconded by Supervisor Paschke, to
adopt the 2010 budget as revised by the townspeople to reduce the
highway budget by $66,500 for total spending to be at $400,000.
Highway spending for 2010 is to include excess from 2009 budget and
$233,500 as presented by the Board for 2010. 3 ayes and 0 nays.

8. UTICA ENERGY NEGOTIATIONS WITH CITY OF OSHKOSH WITH REGARD TO
SEWAGE LINE WITH WASTEWATER TREATMENT
Dan Clark, controller of Utica Energy discussed the history of the DNR
permits and for Utica Energy’s wastewater treatment and plans for the
future. He explained how that the Company is in negotiations with
the City to treat their wastewater. As part of that agreement, Utica
Energy is required to petition to be annexed into the City, once
certain conditions are met. Mr. Clark provided a copy of the 1st
draft Annexation agreement, to the town board and to the Town’s
attorney Steve Sorenson. Attorney Sorenson commented that this
agreement (which the Town of Utica is not a participant of) would be a
good thing, as it keeps Utica Energy a viable business. He also said
that annexation contingencies would most likely take 20-30 years to
happen - as the City would also have to have all contiguous parcels.
Attorney Sorenson also commented that this may lead to future
discussions about Sewer options for the Town of Utica.
9. MUTUAL AID BOX ALARM SYSTEM AGREEMENT.
The mutual aid box alarm system agreement was discussed. Ed Hunter
explained that the contract gives the town mutual aid in emergency
situations free of charge, just as we would also provide aid, free of
charge, to another municipality. Chairman Hintz made a motion,
seconded by Supervisor Paschke to authorize town chair and clerk to
execute the agreement as presented. Document was signed by Chairman
Hintz and Clerk Morrell. 3 ayes and 0 nays. Carried.
10. WINNEBAGO COUNTY 911 EMERGENCY SYSTEM CONTRACT.
The Winnebago County 911 emergency system contract was discussed.
Supervisor Paschke made a motion, seconded by Supervisor Marohn
authorize town chair and clerk to execute the agreement as presented.
Document was signed by Chairman Hintz and Clerk Morrell. 3 ayes and 0
nays. Carried.
11. APPROVE ZONING CHANGE FOR CHAD & MELLISA BOWMAN.
Supervisor Marohn made a motion, seconded by Supervisor Paschke, to
change the zoning from A3 to RRR as unanimously recommended by the
zoning committee for the property owned by Chad and Mellissa Bowman on
Fisk Ave./Burr Oak. 3 ayes and 0 nays. Carried. (See attached
minutes)
12. REPORTS:
1. Board of Appeals.
Variance for Bowman property was granted for a 75 foot setback.
Bob Mitchell variance meeting will be forthcoming.
2. Fire Department.
Ed Hunter said that it was dry outside and reminded us to be
careful while burning
Patsy Beck reminded people to get their flu shots.
3. Plan Commission.
Kranz property conditional use permit will need to be revisited to get
in compliance with zoning. The old permit had expired. He would
like to use the property for a special needs ranch.
4. Educational Opportunities.
• Upcoming Local Government educational opportunities provided by
UW-Extension
13. CORRESPONDENCE.
• DNR meeting notice regarding Rosendale Dairy permit modifications on
Thursday, December 3rd, 2009 5pm at Royal Ridges, Ripon, WI
• Winnebago Health Department notice of Radon information and testing
kits Board discussed setting up a date in the spring to provide water
and radon testing kits to the town
14. PAYMENT OF BILLS.
Supervisor Paschke made a motion, seconded by Supervisor Marohn, to
pay the bills as presented by the Clerk. 3 ayes and 0 nays. Carried.
15. ADJOURNMENT.
Supervisor Marohn made a motion, seconded by Supervisor Paschke to
adjourn. 3 ayes and 0 nays. Carried.
